TERMS & CONDITIONS - ATELIER 360

1. Definitions
Contractor: Atelier 360, represented by Tanya Joustra.
Client: any party engaging services from Atelier 360.
Services: brand strategy, design, communication, content creation, consultancy, workshops, campaigns and other creative work.
2. Applicability
These terms apply to all quotations, agreements and work carried out by Atelier 360, unless otherwise agreed in writing.
3. Quotations & Fees
Quotations are valid for 30 days unless stated otherwise.
All rates are exclusive of VAT and any external costs (printing, hosting, copywriters, photographers, software tools). VAT will be reverse-charged to the client in accordance with applicable regulations.
Atelier 360 works with fixed packages, project fees or an hourly rate.
4. Execution of the Assignment
Atelier 360 undertakes to execute the assignment with care and professionalism.
Project phases may include partial deliveries, feedback rounds and established deadlines.
The client is responsible for providing timely input and feedback.
5. Rights & Ownership
Concepts, sketches and non-selected proposals remain the property of Atelier 360.
Upon full payment, the client receives the usage rights to the final deliverables.
Designs, strategies or texts may not be altered without prior consultation.
6. Confidentiality
Both parties shall treat all information as confidential and will not share it with third parties without consent.
7. Liability
Atelier 360 is not liable for indirect damage, consequential loss or loss of profit.
Liability is limited to the invoice amount of the assignment concerned.
8. Payment
Invoices must be paid within 14 days.
In the event of late payment, Atelier 360 may pause ongoing work.
For long-term projects, an advance payment may be required.
9. Cancellation or Termination
If the client cancels the assignment, hours worked up to that point will be fully invoiced.
Atelier 360 may terminate the collaboration in the case of non-payment or significant disruption of the process.
10. Portfolio Use
Atelier 360 may display completed work in its portfolio, on social media or in presentations unless otherwise agreed.
11. Governing Law
All agreements are governed by Dutch law.
Disputes will be submitted to the court of Zeeland-West-Brabant, the Netherlands
